We provide the service as-is and are not liable for missed doses or health outcomes. You own your data and can delete your account at any time.

Not a Medical Device

Medly is a reminder and adherence tracking tool. It does not provide medical advice, diagnose conditions, or replace instructions from your doctor or pharmacist. Always follow your healthcare provider's guidance regarding your medications.

1. Acceptance of Terms

By downloading, installing, or using the Medly application ("App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Medly. We reserve the right to modify these Terms at any time. Material changes will be communicated through in-app notifications or email. Continued use after changes take effect constitutes acceptance.

2. Description of Service

Medly is a medication reminder and adherence tracking application that enables users to:

  • Record medications with dosage, schedule, and instructions
  • Receive push notification reminders at scheduled times
  • Log dose history (taken, skipped, missed)
  • Create or join family/caregiver groups
  • Allow authorized caregivers to view schedules and confirm doses

Medly is not a medical device. The App does not diagnose, treat, cure, or prevent any disease or medical condition. It does not provide medical advice. All medication-related decisions must be made in consultation with a qualified healthcare professional.

3. Eligibility

To use Medly, you must:

  • Be at least 13 years of age (or 16 in the EU/UK)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law

If you are under the minimum age, a parent or guardian must create an account and use Medly on your behalf.

4. Account Registration

To use most features of Medly, you must create an account using a valid email address. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately if you suspect unauthorized access to your account

You may not share your account credentials with others or create accounts for third parties without their consent.

5. User Responsibilities and Acceptable Use

You agree to use Medly only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App to manage medications for another person without their knowledge and consent
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble the App
  • Transmit any content that is unlawful, harmful, or violates third-party rights
  • Use the Service in a manner that could disable, overburden, or impair the infrastructure
  • Create multiple accounts to circumvent any restrictions or terminations

6. Caregiver Features

Medly's caregiver features allow authorized users to view and interact with another user's medication data. By using caregiver features, you acknowledge:

  • As a patient: You are voluntarily sharing your health information with the caregivers you authorize. You may revoke caregiver access at any time.
  • As a caregiver: You may only use the caregiver features with the explicit consent of the person whose medications you are managing. Accessing another person's health data without their consent may violate applicable laws.
  • Accuracy: Dose logs marked by caregivers should accurately reflect actual administration. Falsifying dose records could have serious health consequences.

7. Medical Disclaimer

IMPORTANT MEDICAL NOTICE: Medly is a reminder tool only. It is not a substitute for professional medical advice, diagnosis, or treatment. The information you enter into Medly does not constitute medical records. Medly does not verify the accuracy of medication information you enter, check for drug interactions, or flag potentially dangerous dosages.

Always consult your physician, pharmacist, or other qualified healthcare provider regarding:

  • Correct medication dosages and schedules
  • Potential drug interactions
  • Any changes to your medication regimen
  • Any medical concerns arising from medication use

In a medical emergency, call emergency services (911 in the US) immediately. Do not rely on Medly for emergency health decisions.

8. Notification Reliability

We make reasonable efforts to deliver push notifications reliably. However, notification delivery may be affected by:

  • Device operating system settings, battery optimization, or Do Not Disturb modes
  • Network connectivity issues
  • Third-party push notification infrastructure (platform-level notification services)
  • OEM-specific battery management on Android devices

You should not rely solely on Medly notifications as your only reminder mechanism for critical medications. For critical medications, maintain additional backup reminder systems and always follow your healthcare provider's instructions.

9. Intellectual Property

The Medly application, including its design, code, trademarks, and content, is owned by Medly and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes.

Your Data: You retain ownership of all data you input into Medly (medication records, dose logs, etc.). We do not claim ownership over your personal health data.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) NOTIFICATIONS WILL BE DELIVERED ON TIME OR AT ALL; (C) THE SERVICE WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING HEALTH CONSEQUENCES ARISING FROM MISSED DOSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $50 IF NO AMOUNTS WERE PAID).

11. Indemnification

You agree to indemnify, defend, and hold harmless Medly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your use of the caregiver features without proper authorization.

12. Termination

By you: You may terminate your account at any time by using the "Delete Account" option in the app settings. Upon termination, your data will be deleted as described in our Privacy Policy.

By us: We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms, with or without prior notice for serious violations.

Termination does not affect any rights or obligations that accrued before termination. Sections 7 (Medical Disclaimer), 10 (Limitations of Liability), 11 (Indemnification), and 15 (Governing Law) survive termination.

13. Subscriptions and Billing

Medly offers optional auto-renewable subscription plans (Premium and Family) that unlock additional features. By subscribing, you agree to the following:

  • Free Trial: Eligible plans may include a free trial period (e.g., 7 days). At the end of the trial, your subscription will automatically renew and you will be charged the applicable subscription price unless you cancel at least 24 hours before the trial ends.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current price unless cancelled. Your payment method will be charged within 24 hours before the end of the current period.
  • Cancellation: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. No refunds are provided for partial periods.
  • Price Changes: We may change subscription prices. We will notify you in advance of any price change. Continued use after a price change constitutes acceptance of the new price.
  • Billing Management: For subscriptions purchased through the Apple App Store, manage or cancel in your Apple ID account settings at Settings → [your name] → Subscriptions. For subscriptions purchased through Google Play, open the Google Play Store → tap your profile → Payments & subscriptions → Subscriptions.

14. Third-Party Services

Medly is built on top of third-party cloud infrastructure to deliver authentication, data storage, and push notifications. Your use of these underlying services may also be governed by the respective provider's terms of service.

The App is distributed through Apple App Store and Google Play Store. Downloads from these stores are also subject to their respective terms of service.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. Contact us at legal@medly.app to initiate dispute resolution.

If informal resolution fails, disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

16. App Store Specific Terms

Apple App Store

These Terms are between you and Medly only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) — Apple has no other warranty obligation. Apple is not responsible for addressing any claims you or a third party may have regarding the App. In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for investigation or defense.

Google Play

Similarly, these Terms are between you and Medly only. Third-party platform providers are not responsible for the App or its content.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must discontinue using the Service and delete your account.

18. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Medly regarding the Service, and supersede all prior agreements.
